1. Acceptance of Terms
By creating an account or using the Libarray app or website (“Service”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, please do not use the Service.
2. What Libarray Is
Libarray is a platform that helps students discover study libraries near them and book a specific seat, for a specific shift, at a specific library. Libarray is a facilitator, not the provider of the library service itself. The actual study space, seating, amenities, and in-library conduct are provided and managed by the individual library (“Library Partner”), which is an independent business, not an employee, agent, or subsidiary of Libarray.
3. Eligibility and Account Registration
- You must be at least 18 years old to create an account. This threshold reflects India’s Digital Personal Data Protection Act, 2023, which requires verifiable parental consent to process the data of anyone under 18 — see our Privacy Policy for more detail on this.
- Accounts are created and accessed via OTP verification sent to your registered mobile number. You are responsible for keeping your phone number and account access secure.
- You agree to provide accurate information when creating your account and booking a seat.
4. Booking and Payment
- Available seats, shifts, and pricing are displayed by each Library Partner and may change from time to time.
- The total price shown at checkout includes the seat charge (set by the Library Partner) and Libarray’s platform/facilitation fee.
- Payment may be made online (via our payment partner, Razorpay) or, where a Library Partner accepts it, in cash directly at the library.
- Libarray facilitates access to a real-world, physical service — a study seat at a physical library. Payments are processed through Razorpay directly and are separate from, and not processed through, any app store’s in-app purchase or billing system.
- A booking is confirmed only once payment is successfully completed (for online payments) or confirmed by the Library Partner (for cash payments).
- Seat availability is subject to real-time changes; in rare cases of a booking conflict, your booking may be automatically cancelled and refunded — see our separate Refund and Cancellation Policy.
4A. Account Credits
From time to time, your account may hold Credits (for example, following an approved refund). Credits:
- Have no cash value and cannot be withdrawn, transferred to another person, or exchanged for money.
- Can only be applied toward future bookings made through Libarray.
- May be forfeited if your account is closed or terminated, subject to applicable law.
5. Digital Pass and Check-In
- Upon a confirmed booking, you will receive a digital pass with a QR code for check-in at the library.
- Your pass is personal to you and tied to your specific booking. Do not share your pass or seat with another person.
- Libraries may deny entry if the pass cannot be verified, appears fraudulent, or is used outside its valid time window.
6. User Conduct
You agree not to:
- Share your account, digital pass, or booked seat with anyone else.
- Attempt to book seats through fraudulent, automated, or abusive means.
- Misrepresent your identity or provide false information.
- Engage in conduct at a library that violates that library’s own rules or applicable law.
Libarray reserves the right to suspend or terminate accounts that violate these Terms.
7. Relationship With Library Partners
- Libarray does not own, operate, or control any library listed on the platform.
- We make reasonable efforts to ensure listings are accurate, but we do not guarantee the accuracy of amenities, seat conditions, or availability shown by a Library Partner.
- Any dispute regarding the physical condition, safety, or conduct at a library should first be raised with that library directly, and may also be reported to us at contact@libarray.com.
8. Fees and Changes to Pricing
Libarray’s platform fee is disclosed to you before you complete payment. We reserve the right to change our fee structure going forward; such changes will not retroactively apply to bookings already completed.
9. Intellectual Property
All content on the Libarray app and website, including the Libarray name, logo, and design, is the property of Libarray LLP and may not be copied, reproduced, or used without our written permission.
10. Limitation of Liability
To the maximum extent permitted by law, Libarray LLP shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service, including but not limited to loss arising from a Library Partner’s actions, facilities, or conduct, which are outside our direct control.
11. Indemnification
You agree to indemnify and hold Libarray LLP harmless from any claims, damages, or expenses arising from your violation of these Terms or misuse of the Service.
12. Termination
We may suspend or terminate your access to the Service at our discretion, including for violation of these Terms. You may stop using the Service and delete your account at any time directly within the app (Profile > Account Settings > Delete Account), or by contacting us at contact@libarray.com.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts at New Delhi, or resolved through arbitration under the Arbitration and Conciliation Act, 1996, at the discretion of Libarray LLP.
14. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms. Material changes will be notified through the app.
